Breakfast @ GSK Stockmann: Cross-border remote work – what are the risks for employers? Allowing employees to work remotely from another country can trigger unexpected tax, labour law and compliance obligations.

Some of the key questions we will address include:

  • Forms of remote work: What are the implications of permanent versus ad hoc remote work?
  • Individual taxation: What happens when employees exceed the 34-day threshold (or 17 days for part-time workers)?
  • Employer compliance: Could foreign payroll, registration or reporting obligations arise – and who bears the additional costs?
  • Labour law: Could mandatory employment protections in the country where the employee works apply?
  • Permanent establishment: Could an employee’s home office or an ad hoc gathering outside Luxembourg create a taxable presence for the employer?

We will explore these and other practical questions in our upcoming workshop on the tax and labour law implications of cross-border remote work.
